01Parties and Acceptance
These Terms of Use ("Terms") constitute the binding agreement between Anchor Uptime ("Company", "we", "us") and any natural or legal person accessing or using the Service ("User", "you").
By registering, accessing or using the Service, you acknowledge that you have read, understand and agree to these Terms. If you do not agree, you must not use the Service.
02Description and Scope of Service
Anchor Uptime is a SaaS (Software as a Service) platform that monitors the online status of websites and servers, response times, SSL certificates and domain expiration dates. The service includes:
- HTTP/HTTPS uptime monitoring (Frontend Probe)
- Heartbeat signal monitoring via WordPress plugin
- SSL certificate expiration date tracking and warnings
- Domain (WHOIS) expiration date tracking
- Email alarm notifications
- Event history and response time metrics
- REST API access (under plan)
The service is provided "as is". No specific uptime (SLA) commitment is made, but we strive to maximize system stability and availability.
03Account Responsibilities
You must register with a valid email address to use the Service. You agree to the following responsibilities with respect to your account:
- Providing accurate and up-to-date information during registration.
- Keeping your password secret; being responsible for all activities that take place on your account.
- Notify us immediately if you notice any unauthorized access to your account.
- Use the account only for your own purposes and not to transfer or sell it to anyone else.
- Declare that you own or are authorized to monitor the sites you monitor.
04Unacceptable Use
The following uses are strictly prohibited:
- Monitoring sites that do not belong to you or that you are not authorized to monitor.
- Attacking, overloading or causing disruptive traffic to service infrastructure.
- Trying to exceed API rate limits with automation or script.
- Trying to reverse engineer the source code of the service.
- Spread illegal content or malware through the Service.
- Attempting to gain unauthorized access to other users' accounts.
- Consuming the bandwidth of the service beyond a reasonable rate.
Domain Authentication and User Responsibility
The Service implements a technical verification mechanism to verify the ownership of the sites to be added to the monitoring. This mechanism confirms the authorization of control over the domain through one of the DNS record or HTTP-based validation methods.
Some edge cases may not be evaluated within the technical limits of the verification process. For this reason, the user declares and undertakes that he/she has the necessary authorization on each domain he/she adds to the monitoring. Legal, financial and administrative consequences that may arise from unauthorized domain monitoring belong exclusively to the user; Anchor Uptime does not assume any responsibility in this context.
Financial institutions and protected infrastructures
Monitoring domains belonging to third parties such as banks, payment systems and public infrastructure may give rise to legal liability under the security policies of the relevant institutions, local legislation or international regulations. Anchor Uptime cannot be held responsible for legal consequences arising regardless of whether the verification mechanism technically restricts such uses.
05Subscription and Payment (Paddle)
5.1 Plans and Pricing
The service is available in Free, Starter, Growth and Agency plans. Current prices are published on the /pricing page. All prices are in USD ($). Paddle automatically calculates and adds VAT/tax based on your location at checkout; additional tax may apply to the price shown.
5.2 Paddle - Merchant of Record
All payments are processed through Paddle.com Market Limited (Paddock House, Newmarket Road, Cambridge, CB5 8UB, UK). Paddle as the legal seller:
- Processes credit card, debit card and digital wallet payments on PCI-DSS compliant infrastructure,
- Issues invoices and receipts in its own name,
- Manages VAT and other taxes,
- Handles payment disputes and chargeback processes.

5.3 Automatic Renewal and Cancellation
Paid subscriptions are automatically renewed at the end of the term unless canceled. Cancellation can be made through the dashboard or the Paddle customer portal. Cancellation is not valid until the end of the current period; there is no refund for the remaining period.
5.4 Plan Upgrade / Downgrade
Plan changes are applied instantly. For upgrades, the difference fee is charged proportionally to the remaining period. There is no refund for downgrades; the new plan will be valid from the next period.
5.5 Free Plan
The Free plan is offered without the need for a credit card and can be used indefinitely within the specified limits. Free plan accounts may be restricted without prior notice if abuse is detected.
06Level of Service and Interruptions
The aim is to deliver the service at an availability rate of over 99%; however, this is not an SLA (Service Level Agreement) commitment and is not guaranteed.
Service interruption may occur in the following cases:
- Planned maintenance work (announced in advance),
- Disruptions caused by the infrastructure provider,
- Force majeure events such as natural disasters, war, cyber-attacks,
- Technical failures and unexpected errors.
We do not have an automatic credit or compensation policy based on the duration of the outage. In case of prolonged outages, we try to announce the situation transparently.
07Intellectual Property
All software, design, trademarks, content and infrastructure related to the Service is owned or licensed by Anchor Uptime. User is granted a limited, non-transferable, non-exclusive right of use only under these Terms.
The User may not copy, distribute, modify, create derivative works from, sublicense or resell the Service for any commercial purpose.
Your tracking data (URLs, metrics, logs) belongs to you. The data is permanently deleted after the retention period expires.
08Limitation of Liability
To the maximum extent permitted by applicable law:
- Anchor Uptime does not warrant that the Service will operate without interruption or error.
- Uptime cannot be held liable for indirect, incidental, special or consequential damages caused by missed events, delayed notifications or incorrect results of monitoring.
- Our total liability is limited to the subscription fee for 3 months prior to the date of the damage.
09Compensation
User agrees to hold Anchor Uptime harmless from and against any and all claims, damages, expenses and attorneys' fees brought against Anchor Uptime as a result of its breach of these Terms, violation of the Unacceptable Use clause, or violation of the rights of third parties.
10Termination
10.1 Termination by the User
You can close your account at any time via the panel. Account closure is applied at the end of the current period; no refund will be made for the remaining subscription period.
10.2 Termination by Anchor Uptime
We may suspend or close your account if
- You breach these Terms,
- Payment failure (after failed collection under Paddle's payment renewal policy),
- Abuse or behavior that threatens service stability,
- Legal obligation or court order.
Except for Unacceptable Use violations, 14 days prior to termination notice will be provided by email.
10.3 Post-termination data
After account closure, your data will be retained in the system for 30 days, after which time it will be permanently deleted.
11Applicable Law and Dispute Resolution
These Terms are governed by the law of Republic of Turkey. Any disputes that may arise between the parties shall be resolved primarily through negotiation; if no resolution can be reached, Istanbul Courts and Enforcement Offices are authorized.
However, this provision does not negate any mandatory legal rights that the user has as a consumer in their home country. For consumers residing in the EU and UK, local consumer protection legislation and UK/EU law governing Paddle will also apply. For users residing in the US, state-based consumer rights are reserved.
12Changes
We reserve the right to update these Terms. Significant changes will be notified by email at least 14 days before the effective date. Your continued use of the Service following the change constitutes your acceptance of the updated Terms.
